Complete the Rent Escrow Checklist

1. Fill in the date.

2. Fill in your personal information in the lines for the Tenant.

  1. Write down your name
  2. Address
  3. Phone number

3. Fill in your landlord's information in the lines for the Landlord.

  1. Write down your landlord's name
  2. Landlord's address 
  3. Phone number

4. Answer the five questions on the checklist.

5. If you have received a water shut off notice from the Department of Public Utilities, check the box under Water Shut Off. 

 

Complete the Rent Escrow Application

  1. Fill in your personal information in the lines for the Tenant on the top of application.
    1. Write down your name
    2. Street address 
    3. City, state and zip
    4. Phone number

  2. Fill in your landlord's information in the lines for the Landlord on the top of application.
    1. Write down your landlord's name
    2. Landlord's street address 
    3. City, state and zip
    4. Phone number

  3. Fill in your name where it says “I, __(tenant’s name)___ state that…”

  4. Fill in your monthly rent amount. 

  5. Fill in your next rental payment due date. You must be current in your rent.
    Example: If your rent is due on the first of every month and you are filing this on the 15th of July, your next payment is due on August 1st

  6. Fill in the date you gave written notice to your landlord.
    1. Attach a copy of the notice to the application.

  7. List the conditions that need to be corrected.
    30 days must have passed since a written notice of conditions was given to your landlord. If it has been less than 30 days you must tell the court why in this section.

  8. Fill in the amount of your current rent.
    This is the amount you will be giving the court. 

  9. Fill in the date range that your rent amount will be covering.
    Example: July 1, 2019 to July 31, 2019

  10. Check the relief sought of the five options available.

  11. Sign the form in front of a deputy clerk at the courthouse or a notary public.

You must deposit the full amount of your rent with the Court. The court accepts cash, check or credit card (please be aware that there is a 5% surcharge for credit and debit card payments). Checks must be made out to Toledo Municipal Court

You can file the rent escrow in person or by mail.

In-Person

The Toledo Municipal Court is located at 555 North Erie Street in downtown Toledo.  Once you come in to the courthouse take the elevator to the basement. The civil division is located directly across from the elevators on the basement level.

Remember to include the rent you are depositing with the court. 

The Citizens Dispute Settlement Program and the Housing Court Magistrate will screen the case to determine whether the case is appropriate for mediation. If the case is not resolved through mediation, it is set on the housing court docket. The tenant will continue to deposit rent with the court until the case is terminated.

You will receive a notice in the mail with your court date and time. The notice will also tell you in what courtroom the hearing will be held.

Bring any documents or evidence you might have with you to the hearing. Examples of things to bring are:

  1. A copy of the notice sent to the landlord and any mail receipts
  2. Any witnesses
  3. Any photographs or documentation of the problems that need to be repaired.
  4. Any reports from a health inspector or building inspector.

At the hearing both the landlord and the tenant will be given an opportunity to explain their problems or concerns.
